Terms of Service

The agreement between you and PeopleStar Enterprises, Inc. for PicturePoppy.

Effective date: September 4, 2026 Last updated: September 4, 2026

These terms are the agreement between you and PeopleStar Enterprises, Inc. ("PeopleStar", "we", "us") for PicturePoppy. They cover picturepoppy.com, the PicturePoppy apps for iOS and Android, and the tour pages we host for you.

By creating an account or using PicturePoppy you accept these terms. If you do not accept them, do not use the service.

Section 15 contains an arbitration clause and a waiver of class actions. Read it.

1. Who may use PicturePoppy

You must be at least 18 years old, and you must hold a current real estate license in a United States state. PicturePoppy is a professional tool and is sold only to licensed real estate professionals.

You may not create an account for anyone else, and you may not share your sign-in with anyone else. On a multi-seat Executive plan, each person who uses PicturePoppy needs their own seat.

2. License verification

Before PicturePoppy opens to you, we verify your real estate license.

Verification is a check that a license exists and is current. It is not an endorsement of you and it is not legal, professional or compliance advice.

3. Your account

Keep your password to yourself. You are responsible for everything done under your account. Tell us at support@picturepoppy.com if you think someone else has access to it.

Sign-in is by your mobile number and password, or by Poppy ID single sign-on. Your mobile number is your identity here and receives verification codes by SMS. Message and data rates from your carrier are your own.

4. Plans, prices and what each one includes

| Plan | Price | What it includes | | --- | --- | --- | | Agent | $19 a month, or $190 a year | 5 active tours at a time, 60 photos per tour, unlimited email sends, AI room labels and AI client emails, photos kept for as long as you subscribe | | Signature | $29 a month, or $290 a year | Unlimited active tours, 150 photos per tour, text a tour to a client, your branding on every tour page, shared tours kept permanently | | Executive | $19 per seat a month, or $190 per seat a year, three-seat minimum | Everything in Signature for every seat, office branding, a shared team library, an admin console, one bill |

Annual is ten times monthly: you pay for 10 months and get 12.

An active tour is one that is not archived. On Agent you may hold 5 at a time. Archiving a tour is how you start a sixth. Archiving never deletes a tour and never breaks its link, so a tour you already sent a client keeps working after you archive it.

Executive is arranged for your office directly with our team and is not sold inside the mobile apps.

We may change prices. If we change the price of a plan you are on, we will tell you by email at least 30 days before it takes effect, and you may cancel before then.

5. Your free trial

Your trial is 14 days, a payment method is required, and you may cancel any time. You get one trial per Poppy ID per product.

6. Billing, renewal and cancellation

On the web. Payments are taken by Stripe. Your subscription renews automatically at the start of each period until you cancel. Cancel any time in the billing portal on your Account page. Cancellation stops the next renewal; it does not refund the period you are in, and you keep the plan until that period ends.

In the apps. Purchases made inside the iOS app are billed to your Apple Account and managed in your Apple Account settings. Purchases made inside the Android app are billed and managed through Google Play. A subscription bought through Apple or Google renews automatically unless it is turned off at least 24 hours before the end of the current period, and it must be cancelled in that store, not here. Refunds for those purchases are governed by Apple's and Google's policies, not ours.

Changing plans. Change your plan at any time. A change takes effect immediately and billing is prorated for the period you are in. If your account is past due you will be asked to update your card before you can change plans.

Failed payment. If a payment fails we will retry and tell you. If it stays unpaid your account may be suspended and, after a reasonable period, closed.

Refunds. We do not offer refunds for periods already begun, except where the law requires one. The 14-day trial exists so you can decide before you pay.

Taxes. Prices are exclusive of sales and use taxes, which are added where they apply.

7. What you upload, and who owns it

You own your content. Your photographs, property information, tour titles, notes and messages remain yours. We claim no ownership of any of it.

You give us the license we need to run the service. You grant PeopleStar a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, transmit and display your content, and to send it to the service providers in our privacy policy, solely so that we can provide PicturePoppy to you and deliver what you ask us to deliver. This license lasts as long as we hold the content and ends when it is deleted, except for tours kept under section 10.

You promise, for everything you upload:

We do not check your content before it goes out. Whether a tour is accurate, lawful and compliant is your responsibility as the licensed professional.

8. Tour pages are reachable by anyone with the link

A tour page is designed so your client can open it with no account and no app. It follows that anyone who has the link can open it. Tour pages are not indexed by search engines and there is no directory of tours, but there is no password either.

Do not put anything in a tour that you would not be willing to see forwarded. If you want a tour gone, delete it; deleting breaks its link immediately.

9. AI features, and what they are not

PicturePoppy uses AI to label rooms in your photographs and to draft the email and the text message you send.

Nothing PicturePoppy generates is legal advice, an appraisal, a valuation, a disclosure or a substitute for your professional judgment.

10. How long we keep your tours

Keeping a tour permanently is a commitment we make to you, not a right we claim over your work. You can always end it yourself by deleting the tour.

11. Acceptable use

Do not:

Reporting. If a tour contains content that should not be there, write to support@picturepoppy.com with the tour link and what is wrong. We review reports and remove content that violates these terms. We may suspend or close an account that repeatedly breaks this section, and we may act immediately without notice where content is unlawful or presents a risk to someone.

12. Availability, changes and our rights

We work to keep PicturePoppy running but do not promise uninterrupted service. We perform maintenance, we depend on third-party services, and things break.

We may add, change or remove features. We will not remove a feature that is a material part of the plan you are paying for without telling you first and giving you a chance to cancel.

We may suspend or close an account that breaks these terms, whose license is not in good standing, or whose payment is unresolved. If we close your account without cause, we will refund the unused part of the period you have paid for.

13. Third-party services

PicturePoppy relies on Stripe, SendGrid, Twilio, OpenAI, Google Maps, ATTOM Data and our hosting provider. Their availability and their terms are outside our control. Property details supplied by ATTOM and map imagery supplied by Google are their data, provided as-is, and may be incomplete or out of date. Verify property facts before you present them to a client.

14. Disclaimers and limits

PicturePoppy is provided "as is" and "as available". To the fullest extent permitted by law, PeopleStar disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and does not warrant that the service will be uninterrupted, error free, or that AI output will be accurate.

To the fullest extent permitted by law, PeopleStar is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost business, lost transactions or lost data, even if we were told such damages were possible. Our total liability for any claim arising out of or relating to PicturePoppy is limited to the amount you paid us in the twelve months before the event that gave rise to the claim.

Some states do not allow these limits, so parts of this section may not apply to you.

You will indemnify PeopleStar against claims, losses and reasonable legal fees arising from your content, your use of PicturePoppy, your breach of these terms, or your breach of a law or a professional obligation, including fair housing law and your MLS or brokerage rules.

15. Disputes, arbitration and class action waiver

These terms are governed by the laws of the State of California, without regard to conflict of laws rules.

Talk to us first. Before starting a formal proceeding, send a written notice of the dispute to support@picturepoppy.com describing what happened and what you want. We will try to resolve it within 60 days.

Arbitration. If we cannot resolve it, you and PeopleStar agree that any dispute arising out of or relating to these terms or to PicturePoppy will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in the county where you live or by video, and not in court, except that either of us may bring an individual claim in small claims court.

Class action waiver. You and PeopleStar each waive the right to a jury trial and the right to participate in a class, collective or representative action. An arbitrator may award relief only to the individual party seeking it.

Opting out. You may opt out of arbitration by emailing support@picturepoppy.com within 30 days of first accepting these terms, saying that you opt out and giving the name and mobile number on your account. Opting out does not affect anything else in these terms.

16. Apple and Google

If you got the app from the App Store:

If you got the app from Google Play, Google Play's terms also apply to your purchase, and Google is not a party to these terms.

17. General

Changes. We may update these terms. If a change matters, we will update the date at the top and tell subscribers by email before it takes effect. Continuing to use PicturePoppy after that means you accept the change.

Ending it. You may stop using PicturePoppy at any time by cancelling. These sections survive the end of this agreement: 7 (the license you granted, for content still held), 10, 14, 15 and 17.

The whole agreement. These terms and the privacy policy are the entire agreement between us about PicturePoppy and replace anything said before.

If part of it fails. If a court finds any part of these terms unenforceable, the rest stays in force.

No waiver. If we do not enforce something, we have not given up the right to enforce it later.

Assignment. You may not assign these terms. We may assign them to an affiliate or to a buyer of the business.

Trademarks. PicturePoppy, OfficePoppy, ShowPoppy, MLSPoppy, ReportPoppy, FilePoppy, Poppy ID and their logos are trademarks of PeopleStar Enterprises, Inc. These terms give you no right to use them.
